EmsanaCare’s Messaging Terms of Use

To access extra benefits and services available through EmsanaCare, you are required to (1) verify your mobile phone number, by entering a code that is sent to the number you provide, and (2) agree to these terms, which become effective upon activation.
EmsanaCare sends and receives messages via recurring SMS (Short Message Service), MMS (Multimedia Message Service) text, secure chat, and email to assist you in finding and selecting a doctor or other health provider on behalf of yourself or other eligible family members, and other services that facilitate provider access, appointments, and coordination between providers (“Services”).
Attestation that the Number You Provide is Yours. You agree to provide your own mobile phone number with an area code within the United States. You may also provide an email address. You acknowledge that messages will be sent to the mobile phone number or email address you provide to EmsanaCare.
Your Messages May Not Be Private. When using EmsanaCare Services to find and access care, messages may include personal information about your health care or health care providers based on the type of information you choose to provide to us and receive via electronic communication. You acknowledge that whoever has access to the mobile phone or carrier account or email address will also be able to see this information.
Your Protected Health Information. You acknowledge that you elect to share and receive Protected Health Information, as defined in HIPAA and according to EmsanaCare’s HIPAA Notice of Privacy Practices, via text, secure chat or email. You are (i) electing to receive such information through an unencrypted method of communication, and that (ii) information contained in an unencrypted e-mail and/or text message is at risk of being intercepted and read by, or disclosed to, unauthorized third parties. The frequency of text or email messages we send to you will vary based on your use of our Services. You will typically receive messages when we have information for you about a provider you have requested information about, an upcoming appointment, a request for feedback about a provider you received care from, or other healthcare information.
Your Responsibility for the Security of Your Device. You are responsible for the security of your information system(s), including its network and related computer equipment and peripherals (“Information System(s)”). In the event you are accessing the Application through a mobile device, you are solely responsible for the access and use of such mobile device, and must keep secure your device access credentials at all times. You are encouraged to fully utilize all security features, including locking, within the mobile device. You agree that it is your responsibility to comply with all applicable laws, rules, or regulations and ensure adequate security of your Information System(s). Each of you and EmsanaCare agree to notify the other of any violation of data security of which they become aware.
No Responsibility for Messaging Charges. EmsanaCare does not impose a separate charge for text messages; however, your mobile carrier’s message and data rates may apply depending on the terms and conditions of your mobile phone contract. You are solely responsible for all message and data charges that you incur. Please contact your mobile service provider about such charges. You may opt out of EmsanaCare text messaging at any time.
Opting Out of Text Messages. To stop receiving text messages, text STOP to the number upon which you are receiving text alerts. Texting STOP to the number from which you are receiving EmsanaCare messages will opt you out of any and all future EmsanaCare text messages. After you submit a request to unsubscribe, you will receive one final text alert from Provider confirming that you will no longer receive text alerts. No additional text alerts will be sent unless you reactivate your enrollment in the text alert program. For questions about text alerts, please contact hello@emsanacare.com. Text alerts may come from any one of these short codes and EmsanaCare may change, add or remove short codes as necessary.
Availability of Messaging Service. EmsanaCare texts are offered on an “as is” basis and: (1) may not be available in all areas at all times; and (2) may not continue to work in the event of product, software, coverage or other service changes made by your wireless carrier. EmsanaCare may change or discontinue any of its text services without notice or liability to you. EmsanaCare and its related companies and each of their respective officers, directors and employees are not responsible and shall not be liable for any losses or injuries of any kind resulting, directly or indirectly, from any EmsanaCare text services or from technical failures or delays of any kind. EmsanaCare reserves the right to cease delivery of text messages to any person at any time in its sole discretion.
